Booking terms: shared cruises
These terms apply to shared cruises booked through LangkawiCruise.com, online or with our team by chat, email or phone. By paying, you accept them for yourself and for the guests you book for. Please read them before you pay.
1. Who you book with
Your booking is with Sinergia Travels Sdn Bhd (Registration No. 201801011752 (1273768-A)), trading as Langkawi Cruise, a licensed travel agency (MOTAC licence 10734), 507, Blk E, Phileo Damansara 1, 9 Jalan 16/11, 46350 Petaling Jaya, Malaysia. We book your cruise with a licensed boat operator, who provides the yacht, the crew, the food and drinks on board and the safety of the cruise. Your confirmation names the operator. These terms apply to every shared cruise booked through us, whichever operator runs it.
2. What is included
The booking page and your confirmation state the cruise, the departure point, the departure time, the duration and what is included. Anything not listed is not included. Where a marina or jetty fee is paid by each guest on the day, the booking page says so before you pay.
3. Prices, ages and alcohol
Prices are in Malaysian ringgit, per guest. Child and adult prices depend on the guest’s age on the cruise date: Premium Shared Eagle Magic, Standard Shared Eagle Magic (EM4) and Non Alcohol Shared Amanpuri 2: children 4 to 12, adults from 13. Premium Shared Super Rich: children 4 to 11, adults from 12. Ocean Magic Shared Cruise, Freesoul Shared Cruise and Premium Sharing Manta Oro: children 3 to 12, adults from 13. Basic RM99 Shared Cruise: children 3 to 4, adults from 5. The booking page shows the price for younger children. Every guest who takes a seat, including an infant, counts in the number of guests. Alcohol is served only to guests aged 21 and over: a guest under 21 who pays the adult price is not served alcohol, and the price does not change. The Premium Shared Super Rich alcohol add-on is for guests aged 21 and over only. The crew may ask for proof of age.
4. Payment and confirmation
You pay the full price when you book. By card, FPX, GrabPay or Alipay at our online checkout, through our payment provider Stripe, the standard price applies. By DuitNow QR or bank transfer, the DuitNow price applies: after paying, send us the payment screenshot on WhatsApp with your booking reference. Seats are not held while you pay by DuitNow QR or bank transfer: your seats are confirmed when we have checked your payment. If the seats are no longer available by then, we offer you another date or another shared cruise; if none suits you, we refund the full amount you paid within 3 working days. Your confirmation, by email or WhatsApp, gives the operator’s name, the meeting point and the check-in time.
5. Changes and cancellations by you
Seats on a shared cruise are reserved for you with the operator and cannot be resold at short notice. Bookings cannot be moved to another date and are not refundable. This includes cancellations for any reason, no-shows, late arrivals and missed cruises caused by flight, ferry or road delays. You may transfer your booking to other guests at no cost: tell us their names before the cruise. If the operator of your cruise allows a date change or a refund in your case, we pass it on to you: your confirmation names the operator, and our Operator policies page summarises its rules. Please check your travel plans before you book and consider travel insurance.
6. Check-in and late arrival
Arrive at the meeting point at least 30 minutes before departure, at the check-in time in your confirmation. The yacht leaves on time and does not wait. If you are late, some operators can take you to the yacht by speedboat at your own cost, when the sea allows; we will tell you whether this is possible. A guest who misses the departure is a no-show, with no refund.
7. On board
Follow the crew’s safety instructions. The captain may refuse boarding to, or end the cruise for, a guest whose behaviour is unsafe or against Malaysian law, for example drunkenness or illegal substances, without refund. Swimming and water activities are at the captain’s discretion and at your own risk. Children are the responsibility of their parents or guardians. Please tell us before the cruise about reduced mobility, a medical condition that matters on a boat, or pregnancy, so that we can check with the operator. Food is prepared by the operator and served as a buffet, with a normal or a vegetarian menu; all food served is confirmed as halal by the operator. We do not take other dietary requests for shared cruises: if you have a food allergy, a dietary need or any doubt about a dish, ask the crew before eating.
8. Weather and safety
Rain alone does not cancel a cruise: cruises normally go ahead in rain, and the captain decides on the route and the stops. If there is an official weather warning, or the captain or the authorities judge the conditions unsafe, the operator may delay, shorten, change the route or cancel the cruise. A weather forecast alone is not a reason to cancel or move a booking. If the cruise is cancelled before departure, we offer you a new date first. If no new date suits you, we refund what the operator refunds us for your booking, within 14 days of receiving it; your confirmation names the operator and our Operator policies page summarises its rules. If the cruise is shortened or changed for safety after departure, there is no refund.
9. Changes by the operator
The operator may change the yacht or the departure point for operational reasons; we tell you as early as we can. If the replacement is of the same or a higher standard and the package is the same, there is no refund. If the operator cannot provide the cruise at all, for example after a breakdown, we offer you a replacement cruise or a new date first; if neither suits you, the refund rule of section 8 applies.
10. Refunds
Refunds go back to the card or account you paid with. Your bank may take several working days to show them.
11. Our responsibility
We are responsible for your booking: taking your booking and payment, booking your seats with the operator, passing your details to it and informing you of changes. The operator is responsible for running the cruise, the vessel, the crew, the food and drinks served and safety on board, and holds the licences and insurance required for passenger vessels in Malaysia. We are not responsible for loss caused by weather, sea conditions or events outside our reasonable control, or for personal belongings on board. Nothing in these terms excludes or limits rights you have under the Consumer Protection Act 1999 or other Malaysian law that cannot be excluded.
12. Complaints and disputes
If something goes wrong, tell the crew at the time and write to contact@langkawicruise.com within 7 days of the cruise, so that we can look into it with the operator. Malaysian law applies. You may bring a claim before the Tribunal for Consumer Claims Malaysia (claims up to RM50,000) or the Malaysian courts.
13. Personal data
We use your details to manage your booking, as explained in our Privacy policy. Before the cruise we collect the passenger list the operator requires (full names and passport or IC numbers) and share it with the operator.
