Booking terms: water activities and tours
These terms apply to water activities and tours booked through LangkawiCruise.com, online or with our team by chat, email or phone, such as island hopping, fun fishing, mangrove tours, jet ski tours and jet car tours. By paying, you accept them for yourself and for the guests you book for. Please read them before you pay.
1. Who you book with
We are Sinergia Travels Sdn Bhd (Registration No. 201801011752 (1273768-A)), trading as Langkawi Cruise, a licensed travel agency (MOTAC licence 10734), 507, Blk E, Phileo Damansara 1, 9 Jalan 16/11, 46350 Petaling Jaya, Malaysia. We book your activity as agent of the activity operator named on the booking page and in your confirmation. The operator runs the activity and is responsible for it: the boat, jet ski or vehicle, the captain, guide and crew, the equipment, the licences the activity requires and your safety during the activity. We are responsible for our booking service: the information we give you, taking your payment and passing it to the operator, and refunds as set out below.
2. What is included
The booking page and your confirmation state the activity, the operator, the departure point, the start time, the duration, the number of guests or units, the ages allowed and what is included. Anything not listed is not included; park, jetty or conservation fees, where charged, are paid on the day.
3. Payment and confirmation
Prices are in Malaysian ringgit, per boat, per unit or per guest as shown. You pay the full price when you book: by card, FPX, GrabPay or Alipay at our online checkout, through our payment provider Stripe, the standard price applies; by DuitNow QR or bank transfer, the DuitNow price applies. Your booking is confirmed when we have checked your payment and confirmed it to you in writing. If the slot is no longer available by then, we offer you another date; if none suits you, we refund the full amount you paid within 3 working days.
4. Changes and cancellations by you
Activities are reserved for you with the operator and cannot be resold at short notice. Bookings cannot be moved to another date and are not refundable. This includes cancellations for any reason, no-shows, late arrivals and missed activities caused by flight, ferry or road delays. You may transfer your booking to other guests at no cost: tell us their names before the activity. If the operator allows a date change or a refund in your case, we pass it on to you. Please check your travel plans before you book and consider travel insurance.
5. Check-in and late arrival
Arrive at the meeting point at least 30 minutes before the start time in your confirmation. A private boat tour (island hopping, fun fishing, mangrove tour) waits up to 30 minutes after the start time and still ends at the scheduled time; other activities leave on time. A guest who misses the start is a no-show, with no refund.
6. Who can take part
The operator sets the minimum ages and the rules for drivers and passengers; the booking page shows the ages we know (jet ski tour: 12 years and above). The operator may ask for an identity document. Guests under 18 take part only with a parent or guardian, who is responsible for them. Fast boats, jet skis and jet cars are not suitable for everyone: do not take part if you are pregnant or have a heart, back or neck condition or a recent injury or operation, and ask your doctor if in doubt. No alcohol or drugs before or during the activity. The operator, the captain or the guide may refuse or stop a guest who does not meet these conditions or who acts unsafely, without refund.
7. Safety
Wear your life jacket at all times on the water. Follow the safety briefing and the instructions of the captain, guide and crew. Swimming and stops are at the captain’s discretion and at your own risk; if you cannot swim, tell the crew and keep your life jacket on. The operator may ask you to sign its own safety or waiver form before the activity. A guest who ignores the briefing or the crew’s instructions is responsible for the consequences.
8. Driving and damage
Where you drive a jet ski or another craft, follow the guide’s route, speed and distance. You are responsible for damage you cause to the craft or its equipment by careless or unsafe use or by ignoring the briefing, as assessed by the operator. Before you start, check the craft with the crew and take photos of any existing damage. The operator may ask for a deposit or an identity document on the day. Damage is settled between you and the operator; we do not collect it. If you disagree with a damage claim, contact us before you pay it and we will help you with the operator.
9. Weather and safety
Rain alone does not cancel an activity. The operator decides on the day whether the weather and sea are safe, and may delay, shorten, change the route or cancel the activity. A weather forecast alone is not a reason to cancel or move a booking. If the activity is cancelled before it starts, we offer you a new date first. If no new date suits you, we refund what the operator refunds us for your booking, within 14 days of receiving it. If the activity is shortened or changed for safety after it starts, there is no refund.
10. Changes by the operator
The operator may change the boat, the craft or the route for operational reasons. If it cannot run the activity at all, we offer you a replacement or a new date first; if neither suits you, the refund rule of section 9 applies.
11. Your belongings
Keep phones, cameras and valuables in a waterproof bag or leave them ashore. Neither we nor the operator are responsible for belongings that get wet, damaged or lost during the activity, unless this is caused by our or the operator’s negligence.
12. Our responsibility
We are responsible for our booking service. The operator is responsible for running the activity, its boats, craft and equipment, its crew and safety during the activity. We are not responsible for events outside our control, such as weather, sea conditions or decisions of the authorities. Nothing in these terms limits rights you have under the Consumer Protection Act 1999 or other Malaysian law that cannot be excluded. We recommend travel insurance that covers water activities.
13. Complaints and disputes
If something goes wrong, tell the crew at the time and write to contact@langkawicruise.com within 7 days of the activity. Malaysian law applies. You may bring a claim before the Tribunal for Consumer Claims Malaysia (claims up to RM50,000) or the Malaysian courts.
14. Personal data
We use your details to manage your booking, as explained in our Privacy policy, and we share the names of the guests with the operator.
