1. These terms
These terms apply to your use of LangkawiCruise.com (the site). The site is run by Sinergia Travels Sdn Bhd (Registration No. 201801011752 (1273768-A)), a licensed travel agency (MOTAC licence 10734), 507, Blk E, Phileo Damansara 1, 9 Jalan 16/11, 46350 Petaling Jaya, Malaysia. Bookings are governed by the Booking terms for shared cruises, the Private charter terms and the Booking terms for water activities and tours, which prevail over these terms where they differ.
2. What we do
We are a licensed travel agency. We sell cruises, yacht charters and activities run by licensed boat operators and other suppliers; the operator provides the yacht, the crew, the food and drinks on board and the safety of the cruise. When you book through us, your booking is with us and our Booking terms for shared cruises or our Private charter terms apply, whichever operator runs the cruise. For water activities and tours, we book as agent of the operator named on the booking page, under our Booking terms for water activities and tours. Our Operator policies page summarises the operators’ own rules; where an operator’s rule is better for you than our terms, for example a refund or a date change, we pass it on. Prices and availability change; a booking exists only when we confirm it in writing (email or WhatsApp) and the payment required has been received.
3. Information on the site
We keep the site accurate and up to date, but photographs show the yachts and places on a given day, and yachts, menus, routes and timings can change. Sunset and departure times are indicative. Nothing on the site is a promise about weather or sea conditions.
4. Using the site
You may use the site to find information and to book for yourself or your group. You may not copy its content for commercial use, scrape it or use it to send unsolicited messages. The texts, photographs and logo belong to us or to our operators and partners and may not be reused without permission.
5. Chat and the virtual assistant
Our website chat and messaging channels may be answered by our virtual assistant, an AI system that says so when it answers. Its answers are information; a price or an availability is confirmed only by a quote or a booking confirmation from our team. Our team reads the conversations and takes over when needed.
6. Links to other sites and apps
The site links to other sites and apps, for example WhatsApp, Google Maps and operator websites. We are not responsible for their content or for how they handle your data.
7. Personal data
How we handle personal data is explained in our Privacy policy.
8. Responsibility
We take reasonable care in running the site. We are not responsible for loss caused by events outside our control, such as the site being unavailable or errors in services run by others. Nothing in these terms limits rights you have under the Consumer Protection Act 1999 or other Malaysian law that cannot be excluded.
9. Law and complaints
Malaysian law applies. If you have a complaint, write to contact@langkawicruise.com and we answer within 7 days. Consumers may bring a claim before the Tribunal for Consumer Claims Malaysia or the Malaysian courts.
